Conditions of Sale
<p>1.) The word "auctioneer" wherever used in these
conditions of sale, means Ritchie's Inc.
<p>2.) While the auctioneer has endeavoured to catalogue and
describe correctly each lot to be sold, guarantee is not
made of the correctness of the catalogue or other
descriptions of the physical condition, size, importance,
authenticity, attribution, provenance, exhibitors, literature,
historical relevance of any lot and no statement anywhere
shall be deemed such a warranty, representation or
condition, and no sale will be set aside on account of any
imperfections not noted. Each lot is sold "as is", "where is"
and without recourse.
<p>3) The auctioneer has the right to refuse any bid and to
advance the bidding at his absolute discretion. The highest
bidder accepted by the auctioneer shall be the buyer. If any
dispute should arise between bidders, or in the event of
doubt on the part of the auctioneer as to the validity of any
bid, the auctioneer may, at his discretion, determine the
successful bidder, or he may reoffer the lot.
<p>4) If the auctioneer decides that any opening bid is too low,
he may reject the same. The auctioneer reserves the right
to withdraw any lot from the sale or to divide any lot, or to
combine any two or more lots at his sole discretion.
<p>5) Title to the offered lot will pass immediately to the bidder
on the sale of the lot and such bidder assumes full risk and
responsibility therefore, and will thereupon pay the full
purchsed price therefore, or such part as may be required.
If the required payment is not complied with, the lot or lots
purchased by this bidder may, at the auctioneer's absolute
discretion, be put up again and resold.
<p>6) Each and every lot sold by the vendor with all faults and
defects and with all errors of description and is to be taken
and paid for whether genuine and authentic or not and no
compensation shall be paid for same.
<p>7) Notwithstanding the previous conditions of sale, if within
14 days after the sale of the lot the purchaser gives notice
in writing to Ritchie's Inc. that the lot sold is a deliberate
forgery and within seven days after such notification the
buyer returns the same to Ritchie's Inc. in the same condition
as at the time of sale, Ritchie's Inc. shall have the right to
have the purchaser obtain, at the purchaser's expense, the
written opinion of two recognized experts in the field,
mutually acceptable to Ritchie's and the purchase, before
Ritchie's determines whether to rescind the sale.
<p>8) PAYMENT shall be made by CASH, CERTIFIED CHEQUE,
VISA, MASTERCARD or INTERAC, and all property shall be
removed by the purchaser at his expense not later than one
business day following the sale. If it is not so removed and
paid for, and if the account is not settled in full, a handing
charge of the greater of 5% of the purchased price or 2%
of the purchase price per month (24% per year) until settled
and removed, will be payable by the purchaser.
<p>9) The auctioneer shall have the right to bid on behalf of
any consignor.
<p>10) For export of certain kinds of property from Canada, a
cultural property export permit may be required from
Communications Canada (613-990-4161). Permits are
issued by Canada Customs offices across the country on
behalf of the Department.
<p>11) Each lot sold is subject to a premium of 15% payable
by all buyers as part of the purchase price.
<p>12) Unless exempted by law, the purchaser is required to
pay Ontario retail sales tax on the total purchase price.
(Buyers not resident in Ontario are exempt if the purchase
is shipped by common carrier). GST will be charged where
applicable.
<p><u>ESTIMATES</u>
<p>After each lot we have printed pre-sale estimates, which are
approximations, educated guesses, based where known on
comparable auction values in Canada; they are not
"prices." Bidding begins about 1/2 the estimate, but the
final price may very well be less or more than any estimate
shown.
