Conditions of Sale:
The sale is conducted as a private auction, the auctioneer acting as an agent and on third-party account. The auction is open to the public.
All lots coming up for auction may be inspected prior to the sale. The auctioneer and consignor assume no liability and offer no warranty for condition or attribution of goods sold. Later reclamations, of whatsoever type, will not be taken into account.
The auctioneer reserves the right to auction off lot numbers in a different order than that in the auction list, to combine, divide, or withdraw lots.
The auctioneer, on behalf of the consignor, has the right to reject any bid or to accept a bid under reserve.
The highest bidder will be acknowledged as buyer when the auctioneer has called out the highest bid three times and no higher bid is offered.
When several persons make the same bid simultaneously and no higher bid is made, the auctioneer having called out the same three times, lots will be cast in order to determine the successful bidder. If there is no immediate agreement on the successful bidder, the object will be put up for resale. This shall also apply if a higher bid submitted in due time has been inadvertently overlooked.
The highest bidder acknowledged by the auctioneer to be the buyer is under obligation to take delivery of the goods and make an immediate payment in DM. The ownership of the lot purchased will not pass to the buyer until the buyer has paid the auctioneer in full. Risk of loss or damage passes to the buyer immediately. If a bid is accepted under reserve, the bidder is, nevertheless, bound to upholding his bid. A cash deposit or a bank certificate confirming liquidity may be required of new customers.
The buyer's premium of 20,88% incl. VAT will be added to the successful bid price.
By default of payment the auctioneer may demand performance of contract or damages for non-performance, and irregardless of that, may put up the lot for resale at the expense of the buyer.
The auctioneer has the right to recover or take legal action for purchase money, arrears, as well as supplementary payments in his own name on behalf of the seller.
Buyer and seller may learn the address of the contractual partners from the auctioneer after the auction is concluded.
Place of fulfilment and only court of jurisdiction is the auctioneer's registered seat of commercial enterprise.
The buyer/seller's statement of account is rendered conditionally subject to verification and revision. The buyer/seller herewith acknowledges the thus resulting credit and/or debit items.
In delivering a bid or placing a written order, the buyer acknowledges the conditions of sale to be binding.
Insofar as claims are made on translations of these conditions of sale, the German text shall prevail.
