No statements made at the sale, on the invoice or elsewhere shall be deemed such a representation or warranty or be subject to liability. Purchasers are advised to inspect and satisfy themselves as regards the items being sold prior to the sale. CFA Ltd. may, but shall have no obligation to consider any reasonable request to refund any items on the grounds of authenticity. Only under the following conditions will a refund be considered: a. CFA Ltd. must be notified by telephone and in writing within 14 days from the date of the sale that the lot is not authentic. b. Within 21 days of the date of the sale, the purchaser must return the lot in the condition received at the time of sale accompanied by a letter from a mutually recognized authority in the field that states that the lot is not authentic. 2. CFA Ltd. reserves the right to withdraw any lot without prior notice. 3. All lots will be sold in numerical order unless otherwise stated by the Auctioneer. 4. CFA Ltd. has the right to reject bids in sole discretion of the Auctioneer. 5. Lots in the sale may be subject to a reserve. The reserve is a confidential minimum price. The reserve will always be set at or below the low estimate. An agent of CFA Ltd. will execute any reserve. The highest bidder is the purchaser as determined by the Auctioneer. Should a dispute in regard to a bid or otherwise arise, the Auctioneer will have sole discretion to determine the purchaser. Bidding increments shall be determined in the sole discretion of the Auctioneer. 6. Any merchandise not paid for in full the day of the auction will be kept in storage for no more than 14 days. After 14 days the merchandise will be resubmitted in the next following auction without reserve, and the purchaser shall be liable for any deficiency plus all costs of sale. 7. CFA Ltd. shall not be liable for any damage to property left on the premises. 8. Personal checks will be acceptable only if bank authorization has been received, or if two forms of identification are approved by CFA Ltd. 9. Purchases are subject to the county’s 8% sales tax on auction purchases unless the purchaser possesses and provides to CFA Ltd. an Ohio/ or other satisfactory sales tax exemption certificate. 10. A buyer’s premium of 20% will be applied to all property sold, to be paid by the purchaser as part of the sale price; however buyers paying by cash or check will pay a 15% buyers premium. 11. CFA Ltd. and the Auctioneer will accept bids from bidders present at the auction, absentee bidders participating by telephone or on the internet and absentee bidders who leave written order bids with CFA Ltd. in advance of the auction 12. The placing of a bid in this auction by any person should be deemed to be an irrevocable acknowledgment of and consent to these Conditions of Sale.
