The auction will be conducted live and online simulcast on Friday, Dec. 14th at 11 A.M. EST at the New York Hilton Midtown Hotel, 1335 Avenue of the Americas & 53rd Street, 2nd Floor, Gramercy Suite, New York, NY.
To bid LIVE, you must register and obtain a bid card onsite at the Hilton Midtown Hotel. Registration will be Friday, December 14th starting at 9:30 A.M. and continues throughout the auction. To register you will need a valid photo ID and a $500 cash deposit. Deposits for unsuccessful bidders will be returned in the same form when exiting.
To bid ONLINE SIMULCAST, register on Bid.TxAuction.com and submit a $1,000 deposit no later than 5:00 P.M. EST, on Thursday, December 13th.
Sales Tax of 8.875% is applicable for all merchandise retrieved in New York City if a resale tax number is not provided. All items will be relocated to Texas if not retrieved on Friday, December 14th. Sales tax of 8.25% will apply to buyers if taking possession of items in Texas. Coins and Bullion are tax exempt.

Paid merchandise can be removed when convenient until 5:00 P.M. EST on auction day, December 14, 2018. All items not picked up on auction day, except for lots 50 and 500-508 (sculptures); will be relocated to the Austin, Texas area and can be retrieved there or shipped at the buyers’ expense. Lots 50 and 500-508 will be relocated to Brooklyn and can be retrieved there or shipped at the buyers’ expense.
Gaston & Sheehan will utilize the following carriers and assess a minimal fee for packaging and handling; UPS, FedEx, US Postal Service and armored transports. Bidders are responsible for making a determination as to the items condition and value from inspection prior to bidding. Inability to observe defects or deficiencies in a lot through inspection is a risk inherent in the auction process and will not be basis for any refund or adjustment in the sales price. Failure to view/inspect any property for sale shall not constitute cause of cancellation of sale. It is hereby warned that bidders should not bid on the basis of photography alone. By placing a bid, you are entering into a legally binding contract and agree to follow through with the purchase of the item should you win the item. The U.S. Marshals Service retains the right to reject any bids for any reason or to make counter offers or accept back up offers at their sole discretion.
All Bidders Must Read and Acknowledge the Prohibited Parties Statement & Buyer's Certification:
USMS Policy Directive 13.7, Persons Prohibited from Purchasing Forfeited Property stipulates that certain individuals are prohibited from purchasing forfeited property in the Department of Justice (DOJ) Asset Forfeiture Program, directly or indirectly (through another person or agent) and are therefore barred from placing bids to buy such property:
a) U.S. Department of Justice employees, including U.S. Marshals Service employees, except as further restricted below;
b) U.S. Marshals Service employees directly involved with the Asset Forfeiture Program, and their immediate family members;
c) Contractors, sub-contractors and the employees of contractors and sub-contractors of the Asset Forfeiture Division, U.S. Marshals Service, who provide contract/management services for personal and real properties and complex assets, including, but not limited to, any person who has received compensation, directly or indirectly, from the Government in connection with the custody, management, and care of the assets;
d) Defendants in a Criminal Case - Titles 18.U.S.C. Section 1963(f) and 21 U.S.C. Section 853(h) of the Comprehensive Crime Control Act of 1984 prohibits the United States Government from reverting to a defendant or any defendant's conviction on charges, or violations of 18 U.S.C. Section 1962 or 21 U.S.C. Section 841 et. seq;
e) As a matter of policy, the USMS extends the purchase restrictions of a criminal case to any person whose conduct gave rise to a civil forfeiture of the property or to anyone acting in concert with or on behalf of, such a person. This general prohibition may be lifted in civil forfeiture actions on a case by case basis due to extenuating circumstances, as determined by AFD and the relevant United States Attorney's Office (USAO), with concurrence of the Ethics Officer, Office of General Counsel (OGC);
f) Other Third Parties- other governmental and non-governmental employees who are, directly or indirectly, involved in the Asset forfeiture and DOJ Equitable Sharing Programs; and
g) Anyone acting in concert with or on behalf of any of the above persons.
In accordance with title 18 U.S.C. Section 1963(g) and 21 U.S.C. Section 853(h), you must certify that you are not acting and will not act in concert with the defendant(s) from whom the property was seized or to any person whose conduct gave rise to a civil forfeiture of the property or to anyone acting in concert with or on behalf of such a person. Understand that any falsification of the information provided in this statement is punishable under the provisions of title 18, U.S.C., section 1001, by a fine of not more than $10,000 or by imprisonment of not more than 5 years, or both. All sales are subject to confirmation by the US Marshals Service.
