BIDDING AND WINNING
PLACEMENT AND ACCEPTANCE OF BIDS
Unless the auction of a lot is announced as absolute, U.S. AUCTIONS LLC reserves the right to accept or reject any bid for any reason whatsoever. Any and all bids made by a Bidder constitute irrevocable offers to purchase the lot at the maximum bid amount of the Bidder and may not be withdrawn by the Bidder under any circumstances. All bidders acknowledge that they are bidding against a reserve set by the consignor and/or the auction house.
At the close and reconciliation of the auction, U.S. AUCTIONS LLC shall determine the actual winning Bidder of each lot and may, at its sole discretion, at any time, offer any Bidder a duplicate item at the Bidder's maximum bid on the lot. In the event of any dispute between bidders, or in the event of doubt on U.S. AUCTIONS LLC?s part as to the validity of any bid, U.S. AUCTIONS LLC will have the exclusive final discretion to determine the successful Bidder, cancel the sale, award the lot to the next highest Bidder or Bidders or to re-offer and resell the lot in dispute. U.S. AUCTIONS LLC is not responsible for any errors or omissions in connection therewith.
U.S. AUCTIONS LLC reserves the right to protect any reserve price by placing floor bids, to place bids on behalf of any buyer or seller, to bid for its own account or to remove any lot from sale without notice.
Any bid entered by a Bidder shall be determined at the sole discretion of U.S. AUCTIONS LLC to have exceeded or not to have exceeded any reserve.
U.S. AUCTIONS LLC?s sole discretion shall be binding upon all bidders. U.S. AUCTIONS LLC reserves the right to group multiple lots together and, prior to bidding, withdraw any lot from the sale. The highest bidder acknowledged by U.S. AUCTIONS LLC shall be the Buyer except in the case where the bid is held by the reserve. U.S. AUCTIONS LLC may accept or reject any bid amount at its sole discretion. U.S. AUCTIONS LLC reserves the sole right to refuse to honor any bid that is not submitted in good faith or supported by references to the satisfaction of U.S. AUCTIONS LLC. Buyer personally guarantees the payment of the item(s) for this sale. If U.S. AUCTIONS LLC deems that the Buyer is in default, U.S. AUCTIONS LLC may, at its sole discretion either cancel the sale of the lot(s) and retain as liquidated damages all of the funds paid by Buyer to U.S. AUCTIONS LLC and/or resell the lot(s) in any manner necessary by U.S. AUCTIONS LLC. U.S. AUCTIONS LLC may be a consignor of this sale. U.S. AUCTIONS LLC reserves the right to add or withdraw items to or from the auction at any time prior to or after the auction without notice even if Buyer has already paid for the item (if the item is paid for by Buyer and withdrawn by U.S. AUCTIONS LLC , then U.S. AUCTIONS LLC shall provide a complete refund to Buyer .)
ABSENTEE BIDS
If you have found a lot (item) that you like, but you don't want to bid at real-time during the auction, you can place an "absentee" bid instead. Approved bidders can place absentee bids up to one hour before the live event begins. When the auction starts, we will then process all the absentee bids and calculate what the winning absentee bid is. The winning absentee bid equals the second highest bid plus one bid increment. This value will be communicated to the auctioneer.
DEPOSIT REQUIREMENTS
If any bidder is deemed a financial risk for any reason, U.S. AUCTIONS LLC, at its sole discretion, may require a monetary deposit to bid in the auction. If the bidder does not purchase anything, this deposit will be refunded. If the bidder is the winning bidder on any lot, this deposit will be applied to the bidder?s bill and any overage will be refunded. If the bidder does not complete the transaction, the deposit will be forfeited.
I BID BY MISTAKE
Upon approval to bid and accepting terms and conditions within the LiveAuctioneers platform, all bids are considered a legally binding contract. If for any reason it should occur that you are unable to fulfill your obligation, the buyer's premium must be met in order to cancel out the transaction. This will allow us to recap our live auction expenses. NO EXCEPTIONS! We strongly encourage household pets of any kind be kept away from your bidding console along with underage children sitting upon your lap while working the live auctions. These are not excuses that will alleviate your obligation for a winning bid. If you anticipate only viewing the auctions, please open the "VIEW LIVE" console and not the one marked "BID NOW" during the live auction event. We conclude buyers having hit the space bar or moved their mouse wrong as to winning items unwillingly. These are still occurrences that happen on the bidders end holding your party responsible.
DISPUTES
Should a dispute arise between bidders or in the event of doubt on U.S. AUCTIONS LLC?s part as to the validity of any bid, U.S. AUCTIONS LLC will have the exclusive final discretion to determine the successful bidder, cancel the sale, or to re-offer and resell the item in dispute and is not responsible for any errors or omissions in connection therewith. U.S. AUCTIONS LLC shall be the sole arbitrator in case of any disputed bid.
Buyer agrees to hold U.S. AUCTIONS LLC harmless from any and all liability arising from U.S. AUCTIONS LLC, its appointed officials, members, employees, auctioneer, the company and its agent and employees, the event organizers, sponsors and or volunteers in connection with this auction.
The auctioneer?s decision is final in all matters.

BUYER'S PREMIUM
A 15% Buyers Premium will be added to the final cost of the item(s). The Buyer?s Premium is charged by auction houses as a fee for facilitating the auction.
SALES TAX
Unless exempted by law, the Buyer is required to pay Connecticut State Sales Tax of 6.0% (if located within Connecticut) and any compensating use tax of another state, and/or any federal luxury or other tax, on the total purchase price including the Buyer's premium (if any). Sales tax can only be avoided if Buyer furnishes US AUCTIONS LLC a valid resale permit or if the merchandise is shipped out of the State of Connecticut.
PAYMENT METHODS
At the close of bidding, you will be sent an invoice with payment options. Bills to a maximum of $1500 may be charged on a credit card through PayPal or paid with an e-check through PayPal. Bills exceeding $1500 must be paid by wire transfer. Once you have chosen your payment option, you will receive an invoice from either PayPal or Bank of America with instructions. If you wish to use your credit card to pay a bill exceeding $1500, you must make your own arrangement with your credit card company for a wire transfer of cleared funds. Your shipping address must be the same as the physical address associated with your credit card.
Usually, payment reminder problems are associated with PayPal e-check payments. E-checks take time to clear, depending on your bank's policies and processing schedules. We cannot process your order until we receive PayPal confirmation that your check has cleared. During this wait, you would continue to receive payment reminders, which you can ignore.
NON-PAYING BIDDER
Payment must be received within two (2) business days after the end of the auction. If payment is not received by the third business day after the auction, we will report all non-paying bidders to LIVEAUCTIONEER and give their accounts to a third party collection agency for collection. Our collections agency will mail and call in order to get payment completed. If not completed, all information is then turned over to all three credit reporting agencies for a default on a contract.
You must notify us of any special circumstances that would delay you from meeting our payment policy requirements. We reserve the right to require the 15 percent buyer?s premium as a deposit if special circumstances prevent you from making payment within the two business days. Under no circumstances is this buyer?s premium refundable. Bidding on U.S. AUCTIONS LLC through LIVEAUCTIONEER is a binding contract.
SHIPPING, HANDLING AND INSURANCE
For U.S. Mainland destinations: 7.99 flat rate shipping. You will be offered the option to add insurance. We reserve the right to require insurance on shipments at our discretion.
Canada & Mexico: USPS Express Mail Service - $17.95 (flat-rate for orders $200 and below.) For orders above $200, actual USPS postal rate will be applied.
For Other International Countries: USPS International Express Mail : Actual shipping fee.
Shipments to Hawaii, Alaska, US Territories and Foreign Countries: Shipping and handling charges to these locations are higher and often require registry or Express Mail. Please email us for actual shipping cost.

SHIPPING & HANDLING
Your item(s) will be shipped within 7 to 10 business days (excluding weekends and holidays) after you complete the 'checkout' process and your payment is confirmed and has cleared to our account.
Our responsibility for damage to or loss of the lot ends once it has been turned over to the USPS, UPS or other shipping company for delivery. By bidding, the winning Bidder agrees that any and all claims for loss or damage to the lot will be handled solely through the insurance claims process or the carrier. Some items may take longer to ship and all items are subject to first being received from the seller in the event that the items were not at our physical location at the time of sale. Buyers should expect their items within 4 weeks after the auction unless there was a delay in processing their payment. All shipments are subject to USPS handling delays which are beyond our control. Bidders will receive an email with tracking information once their items have been processed for shipping. BIDDER'S MUST BE SURE THAT THEIR EMAIL ACCOUNT ALLOWS RECEIPT OF EMAILS FROM USAUCTIONSLLC@gmail.com. BY BIDDING, THE WINNING BIDDER HEREBY AGREES TO OUR SHIPPING DETAILS AS STATED ABOVE.
Insurance will be included for all shipments. We are not responsible for any items that are lost, damaged or stolen while in transit. If you have any questions about insurance and/or shipping costs, please contact us before bidding. Please provide us with a physical residential or business address for delivery. A signature is required for all deliveries and returns.
Although we like to hear from Bidders, all Bidders must refrain from contacting U.S. AUCTIONS LLC or LIVEAUCTIONEER with shipping status requests until 4 weeks after the auction sale. Such requests delay U.S. AUCTIONS LLC in shipping, listing additional lots and handling other customer matters that were not already agreed to in advance.
RETURN SHIPPING INSTRUCTIONS
To receive a refund, you must return your merchandise to us at the address on your packing slip/receipt within 7 days after you receive it. You must properly pack the merchandise and include the original jewelry gift pouch, jewelry tag, copy of the receipt. We must be able to track merchandise being returned. Merchandise must be returned via USPS, UPS, or FedEx, and it must be insured. Merchandise must be returned undamaged and in its original condition. We will generally issue a refund/exchange/store credit within 10 BUSINESS DAYS (excluding weekends and holidays) after we receive the returned merchandise. RETURN AUTHORIZATION NUMBER MUST BE MARKED VISIBLY ON THE OUTSIDE OF THE RETURNING PACKAGE. We do not accept any package without a Return Authorization Number.
LATE SHIPMENTS / LOST PACKAGE IN TRANSIT
DOMESTIC SHIPMENTS ONLY. Once your package is shipped, you will receive a shipment confirmation and tracking number that you can use. Please allow 14 business days (excluding weekends & holidays) after you complete the 'checkout' process and your payment is confirmed, to receive your package. Packages not received on time could be due to delayed shipping or delayed release of item(s) from the seller. In this case, please be patient. If your package is lost by the carrier, please check your tracking number for updated information. If the tracking number of the carrier confirms that your package has a "lost status", then we will replace your item(s) upon availability. We will not be able to replace your lost items if the carrier tracking shows a "delivered status" on the shipment.
INTERNATIONAL AND CUSTOMS
International Bidders are responsible for all taxes (Customs) associated for importation of Merchandise to their country (if applicable). Please carefully consider your final cost, after adding the import taxes (Customs) to your final prices. Please bid accordingly and carefully. Do not ask us to declare lower prices for Customs.

Money-back Guarantee: We will refund your money within 3 business days after we have validated your returned item less insurance and shipping cost, buyers' premium and a 10% restocking fee, and any credit card or bank fees that are not refunded to us. Please inspect lots prior to bidding to avoid returns.
All returns must have a Return Authorization Number to ensure a smooth processing of your refund. Please email us at USAUCTIONSLLC@gmail.com with Subject: Request RAN + your invoice number. Items being returned without a Return Authorization Number visibly written on the box will be refused.
Return for Credit: May have the BID PRICE applied to their future purchase. If the buyer wishes to convert this credit to a refund, the buyers premium will not be refunded. All requests to convert a credit to a refund must be made within six months of the original purchase. The request must be in writing and include the RAN and invoice number.
Return for Exchange: Item exchange is especially useful if you are not happy with your winning item and prefer to receive another item of the same style or another style of a similar item if available. If no suitable item is available, you may request a refund or store credit.
All Returns must be requested within five days of receipt of item.

If you provide us with Negative or Neutral Feedback, you will automatically receive the same in return if we disagree. FEEDBACK DISPUTE RESOLUTION
If you leave Negative or Neutral Feedback against us and we do not agree, then you automatically and irrevocably agree to consent to Square Trade or LiveAuctioneers's feedback removal service to mediate the disputed Negative or Neutral Feedback, with the final result rendered by Square Trade or LiveAuctioneers being binding between the parties. If you fail to consent to Square Trade or LiveAuctioneers to mediate your disputed Negative or Neutral Feedback against us, then you are automatically in default per the terms of this agreement and you automatically and irrevocably authorize and instruct (without any written or verbal instructions) for Square Trade or LiveAuctioneers to remove your negative feedback against us. Your failure to respond to U.S.AUCTIONS LLC, LiveAuctioneers or Square Trades communications to you via Fax, U.S. Mail, e-mail or verbally either in person or by telephone requesting your participation to the mediation confirms your default and your full and irrevocable authorization for Square Trade or LiveAuctioneers to remove the Negative Feedback. GENERAL TERMS AND CONDITIONS
By bidding in this auction you acknowledge that you, Buyer (or Bidder, or Winning Bidder, or Purchaser, each of which four terms may be used interchangeably), hereby agree to be bound by all of the terms and conditions of this auction as described or any lot listing and these U.S. AUCTIONS LLC GENERAL TERMS AND CONDITIONS.
These Terms and Conditions and the information contained in any lot listing constitute the entire agreement between Buyer and U.S. AUCTIONS LLC. These Terms and Conditions and the information contained in any listing may only be changed by U.S. AUCTIONS LLC. By participating in this auction, Buyer acknowledges that Buyer is bound by these terms and conditions and the information contained in any listing
In the event of a conflict between these U.S. AUCTIONS LLC GENERAL TERMS AND CONDITIONS and the contents of any listing, any invoice, or the LIVEAUCTIONEER General Terms and Conditions, these General Terms and Conditions shall supersede and govern.
DISPUTE RESOLUTION
If any dispute occurs between Buyer and U.S. AUCTIONS LLC that cannot be resolved, then the parties agree to the rules, regulations and procedures of the dispute resolution described herein and agree to the following procedures for resolution of the dispute. If either party alleges that the other party is in default under this agreement, then the dispute or allegation shall be submitted to binding arbitration in the State of Connecticut. U.S. AUCTIONS LLC shall select a neutral arbitrator. The arbitration process shall be initiated by either party requesting arbitration which must be served upon the other party by certified mail. Failure to participate in the arbitration is a default. Each party shall simply present their case (limited to a maximum of one hour for each party) to the arbitrator. The parties agree and acknowledge that they are completely waiving their rights to have the dispute heard in a court of law.
The parties agree that the arbitrator shall have complete jurisdiction over the dispute and can issue an award to the prevailing party. Arbitration fees shall be paid by the party not prevailing in the dispute or as seen fit by the arbitrator. Any award determined by the arbitrator shall be binding and the prevailing party shall be awarded full reimbursement of its actual paid fees in connection with the dispute. By signing up to participate in a U.S. AUCTIONS LLC online auction, Bidder specifically agrees to the dispute resolution specified in the foregoing paragraph as Bidder's sole means to resolve any and all disputes which may arise with U.S. AUCTIONS LLC. By doing so Bidder specifically agrees that Bidder will not file a dispute of any kind with LIVEAUCTIONEER, a credit card company, Paypal or any other third parties. In the event that Bidder violates this provision, in consideration of U.S. AUCTIONS LLC?s approval of the application of the Bidder to bid in U.S. AUCTIONS LLC, Bidder confesses judgment to fraud having been committed by Bidder against U.S. AUCTIONS LLC and further agrees that Bidder is liable to U.S. AUCTIONS LLC for all damages, losses and costs, including time charges, resulting from this dispute.
LIMITATION OF LIABILITY
Our liability to a Buyer will not in any case exceed the purchase price actually paid for an item. U.S. AUCTIONS LLC shall not be liable for any breach or default of a consignor. U.S. AUCTIONS LLC 's liability for any breach, or act or omission cannot exceed the purchase price actually paid by the Buyer, and U.S. AUCTIONS LLC shall not have any liability under any circumstances for special, indirect, incidental or consequential damages (including for loss of profits or revenue, costs of obtaining alternative property, claims of customers of buyer or otherwise), whether in contract, tort, negligence, strict liability, or otherwise, arising out of, resulting from, or in any way relating to the item or its purchase, sale, delivery or non-delivery, or the acts or omissions of U.S. AUCTIONS LLC or U.S. AUCTIONS LLC 's agents, representatives, officers, members, managers, directors, or employees.
BINDING CONTRACT:
Bidder's bid at all times represents an irrevocable offer by Bidder to enter into a binding contract to purchase the lot in accordance with the specific provisions of the listing and these General Terms and Conditions, as applicable. In the event that any reserve price of a lot is not exceeded by any Bidder's bid, U.S. AUCTIONS LLC, at its sole discretion, with or without the knowledge of or notice to any Bidder, may reduce any reserve price to an amount below the bid of Bidder at any time during an auction and accept the bid made by Bidder. Reserve prices are always the confidential information of U.S. AUCTIONS LLC and are not disclosed to Bidders unless specifically stated as such during bidding. Nothing contained in any listing shall be construed to disclose any reserve price. In the placing of any bid the Bidder understands and agrees that the bid placed, once accepted by U.S. AUCTIONS LLC, will be the winning bid if there is no higher bid by another bidder and if any reserve or reduced reserve on the lot is exceeded. All bids are binding, irrevocable and non-cancellable by Bidder. There are no provisions for the placing of bids to "mark the lot" or to "test the system", etc., and any requests to cancel bids on these bases, or due to a Bidder not reading a listing, not being familiar with the bidding platform, not doing proper due diligence or failing to maintain proper control over Bidder's bidding terminal, will be denied.
Such requests to cancel bids are null and void and will not excuse Bidder from Bidder's legal and contractual obligation to complete a transaction. If you are the successful Bidder, you agree to pay the amount of your bid plus all applicable taxes and charges in the time and manner designated by U.S. AUCTIONS LLC. Failure to make such payment shall be deemed to be a breach of these General Terms and Conditions, and, in addition to all other rights and remedies U.S. AUCTIONS LLC may have under applicable law, you will be charged a restocking fee of 15 percent.
Bidder is responsible for any and all costs associated with collection of amounts owing from the Bidder until collected. U.S. AUCTIONS LLC reserves the right to bill and collect any such costs from Bidder. Costs associated with collection may include, but are not limited to, time charges, incidental expenses, attorney fees and costs associated with the use of a collection agency. The winning Bidder's failure to complete the purchase in accordance with the terms provided herein and in the listing will cause the Bidder to be faced with all, or any combination of the following measures: elimination of all future bidding privileges on the hosting site; credit agency reporting; legal and/or collection action. These Terms and Conditions and each listing contain all of the provisions applicable to the agreement between U.S. AUCTIONS LLC as Seller and each Bidder.
The provisions of these Terms and Conditions and of each listing supersede all other agreements, representations or understandings, whether prior or contemporaneous, oral or written, between the parties concerning that subject matter. These Terms and Conditions and provisions of each listing shall be binding on Buyer's heirs, beneficiaries, executors, successors and assigns.
SEVERABILITY
If any provision of these Terms and Conditions or of any listing be void, unlawful or unenforceable under applicable law, that provision shall be modified to the minimum extent possible to comply with applicable law, or if modification is not possible, deleted and severed from the remaining provisions. Any such modification, deletion or severing shall not affect the enforceability or validity of any of the remaining provisions.
ASSIGNMENT
Any assignment without U.S. AUCTIONS LLC ?s written authorization will be void.
VENUE
These Terms and Conditions, the contents of any listing and the contractual relationship between U.S. AUCTIONS LLC and any Buyer shall be interpreted under and governed by the laws of the State of Connecticut.
