A bidder is deemed to have accepted the condition and description of an item when making a bid.
The auctioneer reserves the right to withdraw any lot at any time prior to the time of sale of such lot.
Elite Inheritance Auction assumes no responsibility for any liability once a bid is accepted.
Except as set out herein, there shall be no warranties or guarantees expressed or implied, statutory or otherwise of any nature.
Descriptions are believed to be accurate. However it is buyers' responsibility to identify the conditon of an item before bidding.
All items are sold "As Is, Where Is" - catalogues are prepared only as a guide. No sale shall be invalidated for any reason or defect or inaccuracy of description in catalogue or otherwise, and no liability shall be borne by the auctioneers by virtue of any such fault or error. All sales are final.
Removal of purchased lots by purchaser/bidders and guests is done at their sole risk. Elite Inheritance Auction assumes no risk or liability, statutory, common law or otherwise whatsoever for those picking up from the auction location.
All purchased lots must be paid in full by cash or email transfer and picked up on the day of the auction by 8:00 PM MST.
Any items requiring shipping will be dropped off at the UPS West Edmonton 17008 - 90th Avenue NW location on Monday. UPS will contact purchaser for shipping payment. No alternative shipping option available.
20% Buyers Premium and applicable 5% sales tax shall be added to the purchase price.
The purchaser/bidder is not entitled to possession until all purchased lots have been paid for in full. In the event that the purchase prices are not paid within the prescribed time, the auctioneer shall have the right to resell such items in whatever manner he sees fit without notice to the purchaser/bidder. Any shortfall from sale plus commission and expenses thereof shall be paid by the purchaser/bidder.
All costs and responsibilities of removal shall be borne by the purchaser/bidder within the time prescribed by the auctioneer. The purchaser/bidder hereby indemnifies the auctioneer, Elite Inheritance Auction and the vendor of the purchased lot against any and all damages arising from the dismantling and removal of any purchased lot.
Any lots not removed within the prescribed time shall be subject to disposal and service charges at the sole risk and expense of the purchaser/bidder. All such lots shall be deemed as abandoned and shall be subject to resale for the recovery of such charges. The purchaser/bidder shall also be liable for any rent or damages sustained by the auctioneer for failure to remove any purchased lot.
Where the bidder is an individual representing an incorporated company, that individual certifies that he/she is authorized to represent and bind that company for the purpose of bidding and purchasing in this auction. Where the bidder is an individual representing an unincorporated business, the individual will be personally liable for all amounts owing to Elite Inheritance Auction.
If for any reason, Elite Inheritance Auction is unable to deliver any or all of a purchased lot or title thereof, the sole liability of Elite Inheritance Auction shall be the refund of any monies paid to Elite Inheritance Auction on the purchased lot.
Winning bidder of business must make a nonrefundable deposit of 10% of the purchase price, within 24 hours of Winning bid. Commission on business sale will be 5%.
