<span style="font-family:Verdana, Helvetica, Sans-serif;font-size:11px;background:#fff none;margin:0;padding:0;"><strong>Deadlines and close of Internet bidding</strong>
Internet listing will be complete by the sale of each item at the live auction. Full payment for Internet purchases must be received and all items must be removed from 9:00am to 5:00pm CST during the next two business days following the auction
<strong>Buyer's premium and contract</strong>
There will be a 18% buyer's premium added to all live Internet purchases. Your Internet bids are a contract and you are responsible for honoring them.
<strong>Payments</strong>
For buyers attending the auction, payment must be made the day of the sale before removing any merchandise from the facility. Live auction buyers who do not pay the day of the auction will be charged a $10 service fee for not paying and will be billed immediately. Internet buyers must pay for their merchandise at the Purple Wave Auction Co. facility from 9:00am to 5:00pm Monday or Tuesday following the auction. We accept cash, checks, and up to $1000 on MasterCard, Visa, or Paypal. Paypal payments up to $1000 are accepted at pay@purplewaveauction.com.
<strong>Merchandise removal</strong>
Merchandise must be removed immediately after the auction unless prior arrangements are made or items were won by the Internet bidding system. Internet buyers have until 5:00pm Tuesday following the auction to remove all purchases from the auction location after having paid at the Purple Wave Auction Co. as described above.
<strong>Penalties</strong>
Purchases not paid for within two business days of the auction will be charged to the credit card on file. If payment and pickup arrangements are not made by the required time, there will be a $10.00 handling fee assessed per item as well as an additional $5.00 per item per day storage fee for all items without exception beginning the third business day after the auction. Purchases not picked up 14 days after the auction will be forfeit and resold to cover storage fees with no credit given to the original buyer. Buyers' accounts will then be referred to a collection agency.

<strong>Choice lots</strong>
Certain items are sold choice at our auctions; that is, the winning bidder gets to choose among several items sold at the same time. We sell choices by a style of auction called a Dutch auction, which is similar, but not exactly like, eBay's Dutch auctions. After the first winning bidder is done choosing, the price is reduced incrementally until another buyer bids, at which time that buyer gets to be the next to choose among the remaining items at that price. Because a live buyer can bid at any time when items are sold choice, and because the bidding is done immediately once a buyer bids, the only way to effectively represent the Internet bids in these situations is to immediately bid the maximum Internet bid as the price is being reduced. All kinds of items can be sold choice and those which will be sold as choices will be determined by the auctioneer during the auction.
<strong>Winning bidder notification</strong>
Successful bidders will receive an e-mail message within 24 hours of the auction notifying you of your purchase. If you do not, please call us the next business day at 785.537.5057 to inquire about your purchases.

All sales are final and, unless guarantees are specifically stated, as-is. </li><li><em>Legal courses of action</em>
Internet bids are a contract and you are responsible for honoring them. Every legal remedy available will be used to insure the performance of winning bidders. Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless each seller and auctioneer and their employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses including reasonable attorneys' fees and expenses related to, arising from or associated with buyer's, his agents or representatives, use of the site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, and arising out of, based upon, or resulting from any breach or violation by bidder of this site user agreement or any use by bidder of the site or as a result of a dispute with another bidder. </li><li><em>Bid rejection</em>
The Purple Wave Auction Co. reserve the right to reject any and all bids if they so choose. </li><li><em>Announcement priority</em>
All announcements made the day of the sale take precedence over any printed material and this website. </li><li><em>Transferance</em>
No items will be released until full payment has be received. Merchandise becomes the full responsibility of buyer at the close of the auction, and buyer assumes all risk of loss and damage to property until removed from sale premises. </li><li><em>Credit card usage</em>
A 10% credit card hold may be applied to bids to ensure performance. If the terms of the auction are not followed, Purple Wave Auction Company reserves the right to charge the entire amount due to the credit card on file including any storage fees and penalties. </li><li><em>Sales tax</em>
All sales are subject to appropriate state sales tax laws. </li><li><em>Bid retraction</em>
Buyer must acknowledge all terms of the auction and agree not to retract the purchase offer. If you cannot satisfy the terms of the auction please do not bid. </li><li><em>Merchandise removal</em>
Buyer shall be responsible for making arrangements for merchandise removal within two business days of the auction unless otherwise noted. </li><li><em>Assesment of condition</em>
Bidders should rely solely on personal inspection and not on information listed on the site or otherwise provided by auctioneer or seller. Bidder's failure to inspect, or otherwise be fully informed as to the nature, quality, condition, quantity and size of any item will not constitute ground for any claim, adjustment, refund, termination of the contract for sale, or refusal to close the sale. </li><li><em>Inventory limitations</em>
Items not listing a final price after the auction results are uploaded sold for more than the Internet bid to the live crowd and were not tracked by the inventory control number.</li></ul></span>
