A buyers premium of 18 % is added to the purchase price of every item sold. A 3% discount is offered for purchases paid via cash. The purchaser must also pay 7% New Jersey sales tax on the total purchase price, including premium. A state of New Jersey or out of state exemption certificate must be completed and be on file to be exempt from paying sales tax.
Any item damaged during the pre-auction preview must be paid for immediately, with the fair market price being determined by TIME & AGAIN, INC.
The auctioneer may reject any bid or raise not commensurate with the value of the lot. In the event of dispute between bidders, auctioneer’s decision is final. Items may be withdrawn at any time prior to the offering of each lot.
If, within 5 business days after receipt of item, TIME & AGAIN, INC. receives notice from buyer of any item, that the item, in their opinion, is not as represented and satisfies TIME & AGAIN, INC. with proof, TIME & AGAIN, INC. will rescind the sale and refund to the buyer any monies paid with respect to the lot. TIME & AGAIN, INC. must have the lot in its possession, and in the same condition that it was sold, no later than seven business days from the date of auction.
Some lots may carry reserves, or minimum selling prices. This is a confidential figure set by the consignor and TIME & AGAIN, INC. below which a lot will not sell. TIME & AGAIN, INC. will exercise all reserve bids. The highest bidder acknowledged by the auctioneer is the purchaser. In the event of a dispute, the decision of the auctioneer is the sole and final remedy.
The record of sale kept by the auction house will be taken as final in the event of any dispute. Videotapes will be used for confirmation.
The purchaser assumes complete responsibility for items at announcement of the word “sold”.
The purchaser agrees and understands that all purchases must be removed from premises within 4 days of sale. It will be at the discretion of the auction house to offer for resale any purchases not removed from premises in accordance with these terms unless arrangements have been made and agreed to in advance with TIME & AGAIN, INC. A minimum storage fee of $25 per month, not to exceed $100 per month will be charged to buyers & consignors for items left at our gallery.
As a convenience to clients who cannot attend a sale, TIME & AGAIN, INC. accepts and executes absentees bids on their behalf. Absentee bids are accepted on most items offered for sale. However, it is the buyer’s responsibility to comply with the first paragraph of these terms of sale.
Payment is due at the end of each sale in the form of cash, checks, Traveler’s checks, credit cards (Visa, Mastercard or Discover) or Debit Cards. TIME & AGAIN, INC. reserves the right to hold all property until check clears. Potential buyers of expensive lots are encouraged to discuss payment prior to sale. A $25 fee will be charged for all returned checks. If a check fails to clear after second deposit, the purchaser will be held responsible for any and all fees incurred until we have collected good funds, including storage charges. Bad checks or non-payment of purchases will be prosecuted by TIME & AGAIN, INC. to the fullest extent permissible by law, and the names of offenders will be announced to the public and to other auction firms.
Items sold via the Internet will be subject to a 22.5% buyers premium.
TIME & AGAIN, INC. reserves the right to advertise the selling price of any lot.
