Please read before bidding
1. GOOD FAITH - We have attempted to make every
effort to catalog and describe all items correctly. If you
need additional information please contact us. Each
item is guaranteed to be as described in this catalog –
no further. Condition is arbitrary and cannot be
guaranteed. If you have a question on condition or
need more information, please call.
2. TERMS - All items are to be paid for in American
Funds the day of the auction. Buyer must establish an
account prior to the auction to pay by check. Letter of
Credit or Guarantee Card may be requested. Credit
Cards will be accepted for purchases up to $10,000.
2a.) Absentee bidders: Directly after the auction a bill
will be sent to you for your purchases. This bill will be
due upon receipt.
3. RESERVES - This is basically an unreserved auction.
For the few items that might have a reserve it will be
conservative. Reserves in most cases will not exceed
75% of the low estimate.
4. WITHDRAWAL - We reserve the right to withdraw
any property from the sale at any time and shall have
no liability whatsoever for such withdrawal.
5. TITLE - For customers who physically attend the
auction, title passes to the buyer at the fall of the
auctioneers hammer or the announcement of sold.
The buyer then resumes the responsibility of removal
of any items purchased. For customers who do not
physically attend the auction but bid by mail, phone
or online, title passes to the buyer upon their
possession of the item. Shipping can be coordinated
and arranged by Old West Auction but will be paid by
the buyer.
6. RESPONSIBILITY - If you are acting as an agent for a
buyer or bidding for someone else, please be advised
you are responsible for the payment of that item
regardless of your arrangement with the other person.
7. NOMINAL BIDS - Small opening bids or very
nominally advanced bids may be rejected by the
auctioneer.
8. PROTESTED BIDS - In a case of a disputed bid the
auctioneer is the sole arbitrator as to whom the
successful bidder is; and may offer the item for
bidding again.
9. TAXES - Any state or local taxes must be paid by the
buyer unless the buyer has Wyoming Sales Tax
Exemption Form filled out correctly and on file at Old
West Auction office. Non profit organizations must be
approved by theWyoming Sales Tax office prior to the
auction and have a letter stating their Wyoming
acceptance as non profit entity. Taxes are charged on
total of hammer price plus buyers premium.
(Wyoming sales tax is 5% a the time of this printing.)
10. FIREARMS - All firearms will be sold in accordance
with any applicable state or federal law.
11. ESTIMATES - We publish estimated prices as a
convenience only. These are based on approximate
sold prices of past sales and are only educated guesses
on our part.
12. SHIPPING - We will have a shipping company on the
premises for your convenience. Mail and phone
bidders may use this service or make other
arrangements. The auction will, as a service to
purchasers, coordinate and arrange to have the
property packed, insured, and shipped, all shipping
charges will be collected prior to shipping.
13. FAX BIDDING - Mail bid forms may be faxed and
used for bid execution with an established account.
Fax bids will only be excepted until Wednesday, June
20, 12 noon MST.
14. PHONE BIDDING - We will make arrangements with
you in advance to call you just prior to the lot being
sold. If you would like to bid by telephone please
advise us as far in advance of the auction date as
possible. Telephone bids will not be accepted under
75% of the low estimate.
15. A 20% BUYERS PREMIUM WILL BE
CHARGED ON ALL ITEMS SOLD on the internet
16. These conditions of sale and any other applicable
condition, as well as the Purchaser's and auction's
rights and obligations herein shall be governed by,
construed and enforced in accordance with the laws of
the State in which the auction is held. If these
conditions are not complied with by Purchaser, the
auctionmay, in addition to other remedies available by
law, including without limitation, the right to hold the
Purchaser liable for the total purchase price stated on
the signed Confirmation for Purchase Slip, wither (a)
cancel the sale and retain as liquidated damages any
and all payments made by the Purchaser of (b) resell
the property privately or at public auction on three
days notice to the Purchaser for payment of any
deficiency in the purchase price and all costs including
handling charges, warehousing, the expense of both
sales, the commissions, reasonable attorney's fees, any
and all other charges due and incidental damages.
17. If we are prevented by fire, theft or any other reason
whatsoever from delivering any property to the
purchaser, our liability shall be limited to the sum
actually paid therefore by the purchaser.
