Bidder acknowledges that by accepting these Terms & Conditions he or she is entering a legally binding agreement and that by placing a bid during this auction, such bid constitutes acceptance of the following terms:
1. Buyer's Premium: A buyer's premium shall be added to each purchase to reach the total sale price. The buyer's premium is posted on each item detail page.
2. Total Sale Price: The Total Sale Price of an item includes (i) the hammer price (winning bid) of the item, (ii) the buyer's premium, (iii) applicable sales and other taxes due on account of the sale (residents of the State of Washington will pay a sales tax of 8.9%), (iv) packing, shipping transportation and insurance charges, and all applicable customs fees, charges and duties, and (v) any other amount due from the Buyer as may be posted on the item detail page.
3. Online Bidding: By registering to bid through eBay's live auction service you agree to accept eBay's policies of bid history disclosure, including the policy that live online bidders' increments are not reported when bidding against an absentee bid until the absentee bid is surpassed. Bidders may leave absentee bids on items they wish to purchase. For bids placed on the eBay.com website, eBay's Auctioneer will bid for the absentee bidder, which will be displayed during the live auction and on eBay's bid history as an "auction floor bid." You may also place an absentee bid in person if you wish to preview an item at our gallery (see above address); in such case, the Auctioneer will bid for the absentee bidder as aforementioned. The Auctioneer will also be responsible for protecting an item's reserve price, if any, which will also be displayed as an "auction floor bid." "Auction floor bid" is the designation given by eBayLiveAuctions to bids made by the Auctioneer in either situation. All bids left by eBay bidders will be marked with the user's eBay ID.
Please register to bid well in advance of the start time. Neither TM/EM nor its suppliers or affiliates will be held responsible for errors or failure to execute bids. Absentee bids must be submitted electronically during the preview period on http://www.ebayliveauctions.com, or http://www.ebay.com, or in person as noted above.
4. Winning Bid: The highest bidder shall be the Buyer and if any dispute arises between two or more bidders, the auction coordinator shall decide the Buyer.
5. Methods of Payment: Acceptable forms of payment are PayPal, Visa, MasterCard, money order, cashier's check, personal check or company check, all in US dollars.
6. Payment Due: Buyer shall communicate with TM/EMwithin three (3) days of the close of the auction. Payment of the Total Sale Price is due within seven (7) days of notification from TM/EM of the amount due. Title shall pass to the Buyer once payment in full has been made. All shipping charges will be borne by the Buyer and included in the Total Sale Price, unless otherwise negotiated with TM/EM or provided in paragraph 7 with respect to large items. Any risk of loss during shipment will be borne by the Buyer following delivery by TM/EM of the purchased item to the designated shipper, common carrier or postal service.
Failure to remit payment to TM/EM within the time period outlined in this agreement may result in legal action against the Buyer.
7. Packing and Shipping: TM/EM will pack and ship all items which are not too large for standard shipment via UPS or the U.S. Postal Service, and TM/EM is happy to combine shipment of smaller items when practicable.
Larger items, including but not limited to furniture and equipment, must be picked up by the Buyer at TM/EM's warehouse in Edmonds, WA, by appointment. Buyer must arrange for shipment of such items with a third-party shipper. If Buyer does not have a preferred shipper, TM/EM may recommend one at Buyer's request. TM/EM will palletize and wrap such items as required by Buyer's shipper, in which case a handling charge of $30.00 will apply.
8. Reserve Price: Some lots may be offered subject to a reserve price. A reserve is a confidential minimum price below which such a lot will not be sold. TM/EM will act to protect the reserve by bidding through the Auctioneer. The Auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of TM/EM and may continue to bid on behalf of TM/EM up to the amount of the reserve. This may be done by placing absentee bids, consecutive bids, or by placing bids in response to other bidders.
9. Inquiries: All inquiries regarding lots must be sent directly to TM/EM via e-mail to modell@tradermick.com and received 24 hours prior to the start of the auction.
10. Withdrawal Prior to Sale: TM/EM reserves the right to withdraw any lot before the sale and shall have no liability whatsoever for such withdrawal.
11. Guarantee Terms: All items in the catalog are sold as described in "as is" condition. No statement regarding condition, kind, value or quality of a lot shall be construed to be an expressed or implied warranty, representation or assumption of liability by TM/EM. If an item is materially different from that described in the catalog, Buyer shall have 48 hours from the date the item is received to notify TM/EM. After the 48-hour period, all items are considered "as is," without recourse.
The foregoing guarantee is valid only to the original Buyer. The item(s) must be returned in the same condition as when purchased. Discrepancies of description shall be decided by mutually agreed upon experts whose determination must be in writing and is at the expense of the Buyer.
12. Disclaimer and Warranties: All Bidders in the auction acknowledge and agree, as a condition to the acceptance of a bid by the Auctioneer, that:
NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS MADE OR IMPLIED ON ANY LOT IN THE CATALOG, AND NO WARRANTY, WHETHER EXPRESSED OR IMPLIED, IS MADE WITH RESPECT TO ANY LOT EXCEPT FOR A WARRANTY OF TITLE, IT BEING UNDERSTOOD THAT ALL LOTS OFFERED FOR SALE ARE SOLD ON AN "AS IS" BASIS AND THAT THE BUYER CONSEQUENTLY ASSUMES ALL RISKS CONCERNING AND RELATED TO THE QUALITY, DESCRIPTION, CONDITION, AUTHENTICITY AND PROVENANCE OF A GIVEN LOT.
13. All Bidders in the auction acknowledge and agree, as a condition to the acceptance of a bid by the Auctioneer, that:
BIDDER EXPRESSLY WAIVES AND RELEASES, AND FOREVER DISCHARGES TM/EM FROM ANY AND ALL CLAIMS, RIGHTS, DEMANDS AND CAUSES OF ACTION AND SUITS, OF WHATEVER KIND OR NATURE, INCLUDNG BUT NOT LIM ITED TO CLAIMS BASED UPON AUCTIONEER'S NEGLIGENCE, WHETHER IN LAW OR EQUITY, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, WHICH BIDDER MAY CLAIM TO HAVE WITH RESPECT TO AND/OR ARISING OUT OF, OR IN CONNECTION WITH, ANY CHALLENGE TO ANY MERCHANDISE PURCHASED AT THE AUCTION, THE AUCTION PROCEDURES, OR THE PURCHASE OF ANY LOT, IT BEING THE INTENTION THAT THIS WAIVER AND RELEASE SHALL BE EFFECTIVE AS A BAR TO EACH AND EVERY CLAIM, DEMAND, CAUSE OF ACTION AND/OR SUIT OR CONTROVERSY THAT MAY ARISE HEREUNDER OR BE RELATED TO THE AUCTION.
