Each lot in this auction is offered subject to the following Terms and Conditions of Sale, as supplemented in writing or otherwise by us at any time prior to the sale. By registering to bid at the auction, or by placing a bid through any means, you agree to be bound by these Terms and Conditions of Sale. In these Terms and Conditions of Sale, “we,” “us,” “our,” “Seymour” or similar terms mean Seymour Auctions and any of its agents, and “you,” “your,” “buyer” or similar terms mean a person bidding on or buying property.
1. All property is sold “as is,” with no representation or warranty of any kind from Seymour Auctions or the consignor. Because buyers are responsible for satisfying themselves as to condition or any other matter concerning the property, they are advised to personally examine any property on which they intend to bid prior to the auction. As a courtesy, condition reports for any lot are available from Seymour Auctions prior to the sale, but Seymour Auctions assumes no responsibility for errors and omissions contained in the catalog or in any such report provided at the request of a buyer. Any statements made in this catalog or in any condition report, whether orally or in writing, are intended as statements of opinion only, are not to be relied upon as statements of fact and do not constitute representations or warranties of any kind. No sale shall be invalidated by any reason or defect or inaccuracy of description in catalog or otherwise, and no liability shall be borne by the auctioneers by virtue of any such fault or error. All sales are final.
2. Notwithstanding the preceding paragraph, Seymour Auctions does offer a limited guarantee that items offered for sale are not counterfeit, unless otherwise noted in the catalog or at the time of the sale. A counterfeit for this purpose is defined as a modern fake or forgery that was made with the intent to deceive. If a buyer gives us notice within 14 days of the sale that an item that was purchased was a counterfeit and, within 7 days of such notice, provides a written report from an authority that demonstrates that the item was indeed counterfeit and that a fair reading of the catalog description and the auctioneer's statements at the time of the sale did not indicate this, then Seymour Auctions will rescind the sale and refund the purchase price to the buyer. This guarantee is made only to the original buyer (i.e. a registered bidder) and does not extend to any subsequent purchasers. In any event, any liability that Seymour Auctions has for such a sale is limited to the purchase price of the item sold.

3. All prospective bidders are required to register in advance of the sale. We may require photo identification and bank references for registration. By bidding at the auction, a buyer assumes personal responsibility to pay the purchase price bid, plus the buyer’s premium and any additional charges that become due and payable in connection with the purchase of the property. Upon the fall of the auctioneer’s hammer, the buyer assumes all risk of loss and damage to the property, in addition to any obligations, costs and expenses relating to the handling, shipping, insurance, taxes and export of the property.
4. As a convenience to buyers who cannot be present on the day of the sale, we will use reasonable efforts to execute, on a competitive basis, written absentee bids left with us prior to the sale. We assume no responsibility for a failure to execute any such bid, or for errors or omissions made in connection with the execution of any such bid. If requested prior to the sale, we will use reasonable efforts to contact the buyer by telephone to enable the buyer to participate in the bidding by telephone on the day of the sale, but we assume no responsibility for errors or omissions made in connection with any such arrangement. As a convenience to buyers who cannot be present on the day of the sale, we will use reasonable efforts to execute, on a competitive basis, bids left with us via the Internet, whether by absentee or, if available, a live bidding program. We assume no responsibility for a failure to execute any such bid, or for errors or omissions made in connection with the execution of any such bid. Buyers are advised that there may be additional terms and conditions governing the use of Internet bidding services including, but not limited to, those providing for additional charges and fees relating to the execution of such bids. Any such additional terms and conditions are hereby incorporated by reference into these Terms and Conditions of Sale as though such terms and conditions were included herein, and buyers are therefore advised to familiarize themselves with any such terms and conditions prior to utilizing any Internet bidding service.
5. Please note: eBay left bids will compete with other eBay left & on-line bids, as well as all bids placed directly through the auction house (i.e. left bids, phone bids & in-house bidders). eBay’s terms of left bids stating that earlier bids take precedence over later bids applies only with bidding that is done directly through eBay (either left or live on-line bidders during the auction) and do not apply to in-house floor bids. This is because eBay does not provide the ability for auction houses to integrate those left bids left on eBay, nor does the auction house have access to this info left on eBay. Seymour Auctions sells items to the highest bidder to which the hammer falls as bids are introduced live during the auction, whether it is to an in-house bidder, left bidder or on-line bidder. Ties do occur, and in such cases the item will be sold to the bidder to whom the hammer falls during the normal bidding process, neither on-line nor floor bidders take precedence over the other.
6. All lots may be offered subject to reserve, which is the confidential minimum price below which the lot will not be sold. The auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the seller. The auctioneer may continue to bid on behalf of the seller up to the amount of the reserve, either by placing consecutive bids or by placing bids in response to other bidders. The auctioneer has the right, in his absolute discretion, to determine the conduct of the sale, including, without limitation, to advance the bidding, to reject any bid offered, to withdraw any lot, to break down or consolidate any lot or lots, to re-offer and resell any lot, and to resolve any dispute in connection with the sale. In any such case, the judgment of the auctioneer is final, and shall be binding upon all participants in the sale.
7. In addition to the hammer price, the buyer of a lot agrees to pay us a buyer’s premium, together with any applicable sales tax, late payment charges and storage fees. The buyer’s premium on any lot equals 13% of the hammer price. . A 3% discount will be offered with payment by cash or check. Buyer’s premium for Internet purchases on any lot equals 18% of the hammer price regardless of form of payment. All purchases will be subject to state sales tax unless the buyer has provided us with a valid certificate of exemption from such tax. Payment must be made on the day of the sale unless prior arrangements have been made. Internet bidders must pay within 48 hours upon receipt of their e-mail notification. There will be a $25.00 fee charged for all returned checks. If the check is returned a second time an additional fee of $25.00 will be charged. The purchaser will also be responsible for the purchase price and any and all fees incurred in the collection of purchases. All collections of monies by Seymour Auctions will be filed in the state of South Carolina in the court of Colleton County as well as any and all other courts necessary for collection. If the purchaser breaches any of its obligations to pay in full the purchase price of all items for which he/she was the highest successful bidder, Seymour Auctions may exercise all of its rights and remedies under the law including, without limitation, to the following: (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach and/or (b) offering at public auction or private sale, without reserve, any lot for which the purchaser has failed to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale & collection of monies. In addition, we may reject bids by the purchaser at future auctions.
8. All payments must be made in US Dollars, in any of the following acceptable forms of payment:

- Check, with acceptable identification
- PayPal
- Visa, MasterCard, Discover or American Express
- USPS Money Order or Cashier’s Check
We reserve the right to delay delivery of any property until clearance or collection of funds in connection with any payment has occurred and, in any event, title to the property shall not pass to the buyer until clearance or collection of funds has occurred. In any case, as security for full payment to us of all amounts due from the buyer, we retain, and the buyer grants to us, a security interest in the property purchased by the buyer at auction, and in any other property or money of the buyer in our possession or coming into our possession subsequently. We may apply any such money or treat any such property in any manner permitted under the Uniform Commercial Code and/or any other applicable law.
9. Online bidding during the Live Auction is a fast process, therefore, there is no confirmation given - bids will be taken immediately and are irrevocable.
10. Although you are encouraged to take your property with you the day of the auction, items may be left on our premises for up to two working days after the sale. After that time, if other arrangements have not been made, we reserve the right to transfer any remaining items to a storage facility at your risk and expense. Any items so transferred will be subject to a handling fee of 5% of the purchase price. We assume no risk or responsibility for items that are left on our premises after the sale or transferred to a storage facility.
All property not collected within thirty (30) days following the sale date will become subject to storage fees of not less than $5 per item per day, and property may be moved to alternate storage facilities at the buyer’s risk and expense.
11. We may, as a courtesy to the buyer, provide or arrange packing and shipping of small items or refer buyers to Navis Pack and Ship (www.gonavis.com/sc1071 ) for shipping larger items purchased during online auctions. Navis will pick up your lots and transport to their warehouse for proper packaging and shipping. All items are covered by full-value insurance. Navis specializes in shipping fragile, large, awkward and valuable items such as art, antiques, collector items and machinery – almost anything to nearly anywhere in the world. The Greenville, SC Navis is open weekdays from 7:30 AM to 6:00 PM EST and evenings and weekends by appointment. Any such services provided or arranged by us are at the buyer’s sole risk and expense, and we assume no responsibility for any act or omission of any party in connection with any such service or reference.
12. If we become aware of an adverse claim of a third party relating to property purchased by the buyer, we may, in our discretion, rescind the sale. Upon notice of our election to rescind a sale, the buyer will promptly return the property to us, at which time we will refund to the buyer the hammer price and buyer’s premium paid to us by the buyer in respect of the property. This refund will represent the buyer’s sole remedy against us and/or the consignor in case of a rescission of sale under this paragraph 12.
13. These Terms and Conditions of Sale shall govern, to the extent applicable, any private sale of property by us not made through auction.
14. All images and text contained in this catalogue or in any other publication by us, in whatever form, shall remain the property of their respective owners, and the buyer shall have no right of ownership, use or reproduction of any such material by virtue of any purchase of property or otherwise.
15. If for any reason, Seymour Antiques & Auctions is unable to deliver any or all of an awarded lot or title thereof, the sole liability of Seymour Antiques & Auctions shall be the refund of any monies paid on the lot.
16. Seymour Auctions, its auctioneers, or its employees will not be liable for any injury, damage, or loss incurred in conjunction with this sale.
17. If any provision of these Terms and Conditions of Sale is held by any court to be invalid, illegal or unenforceable, such provision shall be disregarded and the remaining Terms and Conditions of Sale enforced in accordance with the original document and in accordance with applicable law.
18. These Terms and Conditions of Sale shall be governed by and interpreted in accordance with the law of the State of South Carolina and, by registering for and bidding in the auction (whether personally, by telephone or by agent), the buyer agrees to submit to the exclusive jurisdiction of the state courts located in Colleton County, South Carolina in connection with any matter regarding this auction.
19. Any bidding on items means you are in compliance and acceptance of the terms of sale as stated herein. The bidder assumes all responsibility of the terms stated upon bidding, including all terms & announcements made at the time of the sale, whether bidding in person, through a representative, by phone, internet bidding, or absentee bidding, and is responsible for all costs upon a successful bid as stated above. We strongly urge you not to bid if you do not agree to the terms & conditions stated above.
