1. All persons are required to be registered in order to obtain an assigned "Bidding Number" from Dubeau Auctions prior to bidding on any item within the auction sale. Valid identification (i.e: valid Driver’s Licence) must be presented to the registration clerk, along with any other criteria advertised, in order to register. The Buyer agrees to provide written confirmation from a source approved by Dubeau Auctions, of their name, permanent address, proof of identity and creditworthiness if Dubeau Auctions so requests. Failure to provide valid identification and other advertised criteria will result in denial of registration and therefore will not be permitted to bid within the auction sale.

2. All sales are final. Dubeau Auctions only acts as an agent for the seller. All articles will be sold on an "AS IS - WHERE IS" basis without warranty or recourse. Every effort is made by Dubeau Auctions to describe correctly the property/item being offered for auction, however the descriptions are purely statements of opinion by the Auctioneer or the auction staff members and therefore they shall not be held liable in regards to the description, condition, quality, suitability, and title ownership of any article or lot when described in a catalogue, advertisement or otherwise and therefore does not provide the Buyer with any warranty or recourse on the said purchases. Any electrical and/or mechanical equipment/goods have not been tested by Dubeau Auctions and therefore the Buyer is solely responsible for researching/testing such goods to ensure they meet safety standards before using them. A preview time is permitted prior to the auction to accommodate individuals to inspect all articles for sale in the condition that they will be sold and purchasers shall be deemed to have relied entirely upon their own inspections and investigations of the items before purchasing. For online bidders who cannot attend the preview to inspect the articles, we recommend you confirm the condition of the articles prior to bidding on them by contacting Dubeau Auctions by either phone or email.

2b. Dubeau Auctions nor the Seller make any representations or warranties, implied or express, to the Buyer, as to whether any lot is subject to any export/import/custom restrictions and therefore it is solely the responsibility of the Buyer to ensure that these regulations are met and that Dubeau Auctions nor the Seller can be held liable or responsible if the purchased lots fail to meet any of the export/import/custom restrictions.

3. Unless legal proof of tax exemption is provided at the time of registration, Federal Goods & Services Tax of 6% and Ontario Retail Sales Tax of 8% will apply to the purchase price + the Buyer’s Premium and/or Internet Fee (as posted/advertised). In the event articles are shipped out of Canada then the item will be exempt from the Ontario Retail Sales Tax and the Federal Goods & Services Tax. (however the buyer's pemium portion will be subject to G.S.T.)

4. The highest bidder acknowledged by the Auctioneer shall be deemed the Buyer. Risk of loss and damage to any lot purchased shall pass to the Buyer upon the fall of the hammer. The Buyer is advised to effect any insurance they may consider necessary regarding their purchase(s). Any duty of the Auctioneer and/or Seller to deliver lots shall be deemed performed upon the fall of the hammer even if a lot is subsequently damaged and/or part thereof has been lost and thus Dubeau Auctions nor the Seller will not be held responsible or liable for any damage, loss or liability of the article once it has been sold.

5. Following payment in full, documents of transfer, including motor vehicle ownership documents, which are in possession of the Auctioneer, will be provided to the Buyer the day of sale or as soon as possible thereafter the auction sale. Dubeau Auctions makes no guarantees that such documents will be in existence. The Buyer accepts full responsibility of buying that item without proper documentation and/or to acquire the proper documentation by their own methods if such documents are not available

6. All articles must be Paid In Full, by one of Dubeau Auctions accepted methods of payment listed above, on the day of the auction sale and before removal from the premises. All articles purchased by the Buyer, at the Buyer’s sole cost and expense, must be disconnected and removed from the premises the day of the auction unless mutually satisfactory arrangements have been made prior to the sale between the Buyer, the Auctioneer and the Seller.

6a) Packing, handling & shipping of all articles purchased by the Buyer is at the entire risk and expense of the Buyer. The Buyer assumes all responsibility for the safe removal/transportation of the articles purchased including any removal/shipping fees, licences, permits and/or insurance requirements and shall be held liable for all costs and damages or repairs to the property/building as a result of negligence on it’s part or on part of anyone hired by the Buyer to remove, dismantle, disconnect and transport the purchased items. Dubeau Auctions nor the Seller will not be responsible for acts or omissions by packers or shippers whether or not such person or entities are recommended by Dubeau Auctions.

6b) In the event the purchaser fails to remove the article(s) within the aforementioned time limit, the Auctioneer reserves the right to claim title to the property sold and hold the defaulter responsible for all storage and/or transportation costs and the expenses involved in the re-sale of the items including loss of revenue.

7. In the event that the Buyer fails to pay, in full, the total amount due, Dubeau Auctions reserves the right to implement any or all of the actions listed below:

- proceed against the Buyer for damages for breach of contract
<Br>
- charge the Buyer interest on the total amount due, at a rate not exceeding 10% per month, commencing on the 8th day after the auction date

- exercise a lien and/or claim title on the item(s) purchased by the Buyer
<Br>
- resell the item(s) or cause it(them) to be resold by Dubeau Auctions by either public auction or by private sale and hold the defaulting Buyer liable for any deficiency between the amount outstanding and the new actual price realized by either public auction or private sale

8. The Auctioneer utilized by Dubeau Auctions, reserves the right, at his/her sole discretion and without prior notice, to withdraw any lot(s) from the auction sale or to divide any lot(s) in the auction sale or to combine any lot(s) in the auction sale or to offer, on choice, two or more consecutive lots which are similar in quantity and description, in the auction sale, to the highest bidder at that same price. The Auctioneer shall determine the advance of the bidding and maintains sole authority to resolve disputes.

9. Dubeau Auctions reserves the right to rescind the sale thereof or permit the removal of any/all items within the auction, by a legal claim of title from a Third Party claim.

10. Dubeau Auctions reserves the right to refuse admission and /or to refuse any or all bids of a particular individual and/or business attending the auction with just cause. Anyone tampering with or moving the articles for sale will be asked to leave the auction. All shoplifters will be prosecuted by law.

11. Dubeau Auctions and it’s employees reserves the right to bid on items either for themselves or for absentee bidders.

12. Any lot put up for auction could be subject to an unpublished reserve price imposed by the seller. If there is a reserve price on an article, the item is identified as such at the introduction of the auction and/or before the item is sold.

13. Absentee, Proxy & Phone bids shall be accepted by Dubeau Auctions provided that the bidder accepts all the Terms and Conditions of the auction sale and that registration has been accepted by Dubeau Auctions 2 days prior to the sale date. The Auctioneer and staff will make every effort to execute the bids competitively. Dubeau Auctions nor it’s employees nor it’s agents are responsible or liable for any neglect of default relating to bids made in connection with absentee, proxy, telephone bid and/or online bids including, without limitation, any telecommunications and/or internet errors or failures. If a absentee or phone bid was successful, the Buyer shall be contacted by phone within 2 days to arrange shipping or pickup arrangements. All shipping costs will be charged to the Buyer and in addition to the purchase price + Buyer’s Premium and/or Internet Fee and all applicable taxes

Every person attending the auction site, before, during and after the auction sale, be deemed to be there at their own will and risk, and with the understanding that potential hazards may exist on the premises where the auction sale is conducted. Dubeau Auctions and it’s staff, the Auctioneer nor the Seller shall not be held liable or responsible for any personal injuries, accidents or loss which may occur from any cause whatsoever in regards to the auction being conducted.
